- Scope
- This Refund and Cancellation Policy ("Policy") applies to all paid services offered by KC LEGAL ("we," "us," or "our") through our website [www.example.com] and any authorized channels.
- It governs refunds, cancellations, and fee adjustments related to legal services, consultations, document preparation, and other paid engagements.
- Engagement and Fee Structure
- Our fees may be fixed, hourly, or contingent as described in the Engagement Letter/Fee Agreement for each matter.
- Retainers or advance deposits (retainers) may be payable before work begins and are governed by the Engagement Letter.
- Any refunds or adjustments will be handled in accordance with this Policy and the terms of the Engagement Letter.
- Cancellation by Client
- Standard Procedure: If you wish to cancel a matter after engagement, please provide written notice to [designated contact, e.g., email address or portal].
- Fees for Cancellable Matters:
- If the matter has not yet commenced or only preliminary work has been performed, you may be eligible for a partial refund of unearned fees and/or retainer, subject to deduction for any non-recoverable costs and work already performed.
- If substantial work has already been performed or significant resources have been committed, refunds (if any) will be calculated on a time-and-materials basis or as specified in the Engagement Letter, minus reasonable, non-recoverable costs and administrative fees.
- Non-Refundable Fees: Certain costs may be non-refundable (e.g., government filing fees, courier charges, disbursements) and will be deducted from any refund if applicable.
- Disbursements: You are responsible for reimbursing any third-party disbursements actually incurred on your matter, whether the matter is canceled or completed.
- Cancellation by Firm
- We may terminate or suspend work on a matter for reasons including, but not limited to: non-payment, ongoing non-cooperation, conflicts, or ethical concerns.
- In such cases, any prepaid retainer or fees for work performed up to the termination date will be billed and due; refunds for unearned portions will be processed in accordance with the Engagement Letter and applicable laws.
- If a conflict or inability to proceed arises, we will provide written notice and, where feasible, offer to transition the matter to another attorney or firm, subject to our engagement terms.
- Refund Process and Timeline
- Refund requests must be submitted in writing to [designated contact].
- We will acknowledge receipt of a refund request within [X] business days.
- Any approved refund will be issued to the original payment method or by other means agreed upon in writing, within [Y] business days after approval.
- Refunds may be subject to processing fees or non-recoverable costs as described in the Engagement Letter.
- Fees and Billing Disputes
- If you dispute a bill, you must provide written notice within seven days of the invoice date, detailing the basis for the dispute.
- We will review the dispute and respond within a reasonable period, generally within [P] days. Disputed amounts may be placed in a hold or escrow until resolved.
- Disputes regarding refunds, cancellations, or fees do not suspend your obligation to pay for non-disputed amounts per the Engagement Letter unless otherwise agreed.
- Compliance with Law and Ethical Rules
- All refunds and cancellations will be handled in compliance with applicable laws, including the Indian Contract Act, 1872, Advocates Act, 1961, Bar Council of India Rules, and any relevant professional conduct rules.
- Nothing in this Policy overrides mandatory provisions of law or regulatory guidelines that apply to lawyer-client engagements.
- Fees for Ancillary Services
- For any ancillary services (e.g., document drafting, notary services, translations) hired separately, refunds will be subject to the provider’s policies and the terms set at the time of engagement, in addition to this Policy.
- Data and Confidentiality
- Refund-related communications will be treated confidentially as part of the attorney-client relationship, in accordance with our Privacy Policy and applicable professional ethics rules.
- Changes to the Policy
- We may update this Policy from time to time. The Effective Date at the top will indicate the latest version. Material changes will be posted on the Website and communicated to existing clients as required by the Engagement Letter or applicable law.
